1. Agreement to Terms
These Terms & Conditions ("Terms") govern your use of the website at concretearttri.com and any services provided by ConcreteArt Tri State ("ConcreteArt," "we," "us," or "our"). By using the site or engaging us for services, you agree to these Terms. If you do not agree, please do not use the site or our services.
These Terms work alongside our Privacy Policy. Where there is a project-specific written agreement, that agreement governs the project and these Terms govern your general use of our website and brand interactions.
2. Use of the Website
You may use this website for lawful, personal, and non-commercial purposes. You agree not to:
- Use the site in any way that violates any applicable law or regulation
- Attempt to gain unauthorized access to the site, its systems, or its data
- Upload viruses, malware, or any other malicious code
- Scrape, copy, or harvest content for commercial purposes without our written consent
- Impersonate any person or misrepresent your identity
3. Intellectual Property
All content on this site — including photographs, project documentation, written content, the ConcreteArt Tri State name, logo, and visual identity — is the property of ConcreteArt Tri State or its licensors and is protected by copyright and trademark law.
You may share our site links and project photographs on personal social media, with credit. You may not reproduce, modify, redistribute, or use our content for commercial purposes without written permission. Project photographs of our completed work remain our property; we may use them in marketing, with reasonable client coordination on residential projects.
4. Consultations & Quotes
Initial consultations are complimentary and carry no obligation. Quotes provided after a consultation are valid for 30 days from the date issued. Pricing assumes site conditions described during consultation; significant changes in scope, substrate condition, or fixtures discovered during prep may require a written change order.
A signed project agreement and deposit are required to schedule installation. Deposit terms, payment schedules, and project-specific deliverables are detailed in your project agreement.
5. Services & Workmanship
We provide microcement application and related luxury finishes, hand-applied by trained installers. Our work is performed in accordance with manufacturer specifications and industry best practices for the products we apply.
Microcement is a hand-applied artisan finish. Slight variation in color, texture, and movement is inherent to the craft and is part of the finish's character. Photographs and sample swatches represent the general aesthetic but are not a guarantee of identical reproduction. We provide on-site sample mock-ups before final application for client approval.
6. Payment Terms
Payment terms are detailed in your individual project agreement. In general:
- A non-refundable deposit is required to reserve project dates
- Progress payments may be required at defined project milestones
- Final balance is due upon completion and client walk-through approval
- We accept payment by check, ACH, and major credit cards (card payments may include a processing fee)
- Past-due balances accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is lower
7. Cancellation & Rescheduling
Once a project is scheduled and a deposit is paid:
- Cancellations more than 14 days before the scheduled start: deposit refundable, less any costs already incurred (samples, materials ordered, etc.)
- Cancellations within 14 days of scheduled start: deposit non-refundable
- Reschedules with reasonable notice are accommodated where our calendar allows, at no additional cost on the first reschedule
8. Warranty & Aftercare.
ConcreteArt Tri State warrants its installation work for a period of five (5) years from the date of project completion against:
- Material delamination from properly prepared substrates
- Cracking caused by application defects (excluding cracks resulting from substrate movement, structural settlement, or impact damage)
- Sealer failure under normal residential use
This warranty is provided to the original client at the project address and is non-transferable upon sale of the property unless explicitly extended in writing.
What's Not Covered
- Damage caused by misuse, abrasive cleaners, or unapproved chemicals
- Damage from impact, sharp objects, or extreme heat
- Cracks or movement caused by structural shifting, water damage, or substrate failure outside our scope of work
- Normal wear in high-traffic wet areas (sealer renewal recommended every 5–7 years for showers and wet rooms; this is maintenance, not warranty)
- Color variation due to UV exposure over time, which is inherent to mineral finishes
Filing a Warranty Claim
If you believe a warranty issue has occurred, contact us at [email protected] or 551-319-8019 with photographs and a description of the issue. We will respond within 5 business days and schedule an in-person assessment if warranted.
9. Care & Maintenance
To maintain your microcement finish:
- Clean with neutral pH cleaners (mild dish soap and water work well). Avoid acidic or abrasive products.
- Wipe up spills promptly, especially anything acidic (wine, citrus, certain cleaners)
- Use bath mats in shower entry zones to manage standing water
- For showers and wet rooms, allow surfaces to dry between uses where possible
- Sealer renewal is recommended every 5–7 years for high-use wet areas; we offer a maintenance service for this
A detailed care guide is provided to every client at project completion.
10. Limitation of Liability
To the maximum extent permitted by law, ConcreteArt Tri State's total liability for any claim arising from your use of our website or services is limited to the amount you paid for the specific service that gave rise to the claim, or $100 USD, whichever is greater.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless ConcreteArt Tri State and its founders, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of the site, or violation of any law or third-party right.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising under these Terms or related to our services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Bergen County, New Jersey, under the rules of the American Arbitration Association.
Class action waiver. You agree to resolve any disputes individually, not as part of a class, collective, or representative action.
13. Changes to These Terms
We may update these Terms periodically. The "Last Updated" date at the top of this page reflects the most recent change. Material changes will be communicated through the website or by direct notice. Continued use of the site or our services after changes are posted constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
